Contest Dates:
The "WFAN - New York Auto Giant Fan Football Challenge" (the "Contest") will be conducted during the full 2009 scheduled football season. The Contest will begin on September 10, 2009 at 1:00pm Eastern Time (ET) and end on February 8, 2010 at 6:00am ET ("Contest Dates"). The Contest will cover the 2009-10 regular season and post season scheduled football games played during the Contest Dates.
Eligibility:
The Contest is open to all persons who are 18 years of age or older and who reside in New York, New Jersey, Pennsylvania and Connecticut. Employees of New York Automotive Giant (the "Sponsor"), WFAN(AM) (the "Station"), its licensee, and each of their respective parent, subsidiary, and affiliated entities, (collectively, the "Released Parties") their advertising and promotional agencies, participating sponsors, and the members of their immediate families and/or households are ineligible to win prizes. Only one prize winner per household is permitted in the Contest. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children's Online Privacy Protection Act.
How to Enter:
To participate in the Contest during the Contest Dates, visit WFAN.com and select the WFAN - New York Auto Giant Fan Football Challenge banner and/or hyperlink to open the Contest Webpage managed by Poolhost.com ("Host"). Following the instructions, enter and submit during the Contest Dates your first name and last name, complete address, city, state, zip code, telephone number, date of birth, a valid email address, username and password and select your predicted winners for each professional football game on the schedule for that weekend. No spreads will be permitted. Each week WFAN will select one (1) WFAN Host that entrants will be playing against for that week. Entrants must select their predicted professional football team winners in each game of the week. One (1) point will be awarded to each entrant for each correct pick and zero (0) points will be awarded for a tie or a loss of the entrant's selected team. If one or more entrants predict more games correctly than that particular WFAN Host selected for the week, the entrant(s) will be automatically entered into a weekly random drawing in which one (1) entrant will be selected by WFAN at random to win a $250 pre-paid gift card (e.g., American Express or similar issuer.)
The deadline for entering is 12:00pm ET (noon) every Sunday throughout the Contest Dates. On weeks in which there are Thursday or Saturday games, those respective games will not be included in the pool. On Thanksgiving Day weekend an exception will be made and WFAN will post all picks on Wednesday at 12:00pm ET (noon). Monday night games will be included in each weekly competition. One (1) potential winner will be announced each week during the Contest Dates on or around Tuesday of every week.
Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of the Station and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by the Host. The Host's computer shall be the official time keeping device for the Contest. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems.
Weekly Deadlines and Weekly Prize Winner Selection:
To be eligible for a chance to win a Weekly Prize, entrants must select their picks during the respective week by the deadline shown on the pool's home page, www.poolhost.com/wfan. Entry and selection deadlines posted on www.poolhost.com/wfan shall be stated in Eastern Time and shall be incorporated into these Official Rules by reference.
Each week, all entrants with more points than the designated WFAN Host for each week will be automatically entered into a weekly drawing for one (1) $250 pre-paid gift card (e.g., American Express or similar issuer). WFAN will randomly select one (1) person each week to be a weekly prize winner pending verification of eligibility. A maximum of one (1) Weekly Prize winner will be selected each week during the Contest Dates (Regular season & Playoffs) for an aggregate total of twenty one (21) Weekly Prize winners.
Grand Prize Winner Selection:
After the close of the NFL Season (including the playoffs) on February 8, 2010, one (1) potential Grand Prize winner will be selected by WFAN in a random drawing of all valid Weekly Prize winners. Grand Prize award shall be awarded pending verification of eligibility. Odds of a Weekly Prize winner winning the Grand Prize shall be approximately 1:21. Grand Prize winner is not required to listen to WFAN to win. Grand Prize winner will be notified by telephone.
Prizes:
One (1) Grand Prize: a 2010 Hyundai Elantra SE (MSRP: $18,200.00). Prize Winner will be solely responsible for any applicable vehicle title, license and registration fees, freight, delivery, dealer prep, emissions inspection, additional equipment, all federal, state and local taxes, insurance, gasoline, vehicle maintenance, all other fees and expenses not specified herein associated with the receipt and use of the Prize. Any additional options (including the interior and exterior color) not specified herein are subject to availability and will be the responsibility of the Winner. Prize Winner must provide proof of insurance and a valid driver's license to take delivery and must take delivery at a dealership designated by WFAN and New York Auto Giant by March 1, 2010. Prize is not transferable. Prize may not be substituted or redeemed for cash, except that WFAN may, at its sole discretion, substitute prize of comparable value or cash solely at its discretion. The prize vehicle is provided as is. Neither WFAN Radio nor New York Auto Giant has made or is responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the Prize vehicle, including without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer's warranty that may apply to the vehicle.
Twenty-One (21) Weekly Prizes: a $250 pre-paid gift card (e.g., American Express or similar issuer selected solely at the discretion of WFAN.) (Weekly Prize Approximate Retail Value ("ARV"): $250 each.)
Aggregate ARV of all Prizes offered: $23,450.
Prize Conditions:
Decisions of the Station with respect to the Contest are final. Winners must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within ten (10) days of notification attempt or prize will be forfeited and an alternate winner may be randomly selected. If this occurs, the second place entrant will be chosen as the alternate winner pending verification of eligibility. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner shall forfeit the prize. There is no substitution, transfer, or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
General Conditions:
Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner's full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other station owned by the corporate entity that owns the Station) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS. By participating in the Contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize. Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require Contest winner (and any travel companion(s) or guest(s)) to sign a liability release, agreeing to release and hold harmless the Released Parties and their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Contest. If for any reason this Contest cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Contest, or if the Contest is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate or modify the Contest. If the Contest is terminated before the original end date, the Station will select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station's website or Host website. Failure to comply with the rules of the Contest may result in a contestant's disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Contest, the Station reserves the right to disqualify that entrant from entering and/or winning future Contests and to prosecute and seek damages to the fullest extent permitted by law. The Station reserves the right to make changes in the rules of the Contest, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Contest and shall not be required to award a substitute prize. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest or in the announcement of a prize.

For a copy of these Official Rules, send a self-addressed stamped envelope for receipt by February 8, 2010 to "WFAN / New York Automotive Giants Contest - Official Rules," Attn: Promotions, WFAN-AM, 34-12 36th Street, Astoria, NY 11106. For the names of the prize winners send a self-addressed stamped envelope for receipt by April 3, 2010 to the above address marked "WFAN / New York Auto Giant Fan Football Challenge - Winner List." The Official Rules and the Winner List (when completed) shall also be available during regular business hours at the main offices of the Station and shall be posted online at www.wfan.com.
